If you do not consent to this Policy, you may no longer use our products. These Terms constitute a legal agreement between you and AVC SERVICES, LLC dba CHOOSE SMART NOW. By using our Services, you acknowledge and agree to be bound by the Terms, and all the future amendments and additions to these Terms as published on our website and applications. Notice of such additions and amendments will be posted to our websites and applications.
Users may only access the Platform by authorized means only. It is all users’ responsibility to ensure that they have downloaded the right application for their devices.
AVC SERVICES, LLC dba CHOOSE SMART NOW reserves the right to modify and amend the Terms at any given time effective immediately upon posting.
AVC SERVICES, LLC dba CHOOSE SMART NOW is a platform that enables the connection of shippers and drivers for transportation and logistical purposes. You acknowledge that CHOOSE SMART NOW does not provide transportation or delivery service; it is a digital platform that connects shippers with drivers. Our drivers are self-employed and independent contractors who willingly choose to perform services for AVC SERVICES, LLC dba CHOOSE SMART NOW. The Platform is not responsible for drivers’ actions and performance. The company has no control over accuracy of shippers’ listing, as well as we cannot guarantee the identity of all the users.
Our services are only available to and can only be used by individuals who can form legally binding contracts under applicable laws. All users must be over 18 years of age and have a lawful citizenship or eligibility to work in the USA. By using our Services, all users guarantee that they have the right and authority to enter into this agreement and to abide by these Terms.
In order to use the Services, all users will have to create a personalized user account on the platform. No user or a person without a user account may use other user’s account. When creating a user account, all users are expected to provide correct, accurate, and complete information. It is the responsibility of all the users to always keep the information up to date. All users are solely responsible for the activities that occur on their user accounts. It is the responsibility of all users to keep their sign in credentials safe and confidential. All unauthorized activity has to be notified to the AVC SERVICES, LLC dba CHOOSE SMART NOW immediately. AVC SERVICES, LLC dba CHOOSE SMART NOW will not be liable for any losses as the results of unauthorized use of user accounts.
When creating a user account, all users give permission to receive platform-related information including but not limited to notices, updates, messages, promotions.
The platform may utilize the services of third parties in order to facilitate and improve platform’s processes. AVC SERVICES, LLC dba CHOOSE SMART NOW does not control the activities of third parties. You acknowledge that different terms and conditions may apply of such third parties’ services and content.
As it is our priority to create a safe and inclusive environment for all our users, AVC SERVICES, LLC dba CHOOSE SMART NOW prohibits any discrimination including but not limited to discrimination based on race, religion, sexual orientation.
AVC SERVICES, LLC dba CHOOSE SMART NOW prohibits all users from communicating in an aggressive, confrontational, and threatening way towards others.
When providing any kind of content through our platform, users retain the right for that content and are solely responsible for the content they submit. By providing any kind of content to AVC SERVICES, LLC dba CHOOSE SMART NOW, all users give AVC SERVICES, LLC dba CHOOSE SMART NOW an irrevocable, non-exclusive, royalty-free license to use, store, display, reproduce for the purpose of providing the platform services. At its sole discretion, AVC SERVICES, LLC dba CHOOSE SMART NOW may remove or take down any content that will be found to be in violation of these Terms.
The Platform is not designed for individuals under 18 years of age, and we do not knowingly collect any information from individuals under 18. No one under the age of 18 may use the Services of our Platform and may not assign or otherwise transfer Account to any other person or company.
The company may change the Services, stop providing the Services or create limitations to certain users. AVC SERVICES, LLC dba CHOOSE SMART NOW may temporarily suspend any user’s access to the platform without any prior notice at our sole determination. Upon termination, all users continue to be bound by these Terms.
It is the responsibility of all drivers to know and oblige to all the applicable federal, state, and local laws concerning delivery. AVC SERVICES, LLC dba CHOOSE SMART NOW will not be held responsible in case if any driver is not compliant with any laws.
All the drivers are responsible to obtain all the required documents, including but not limited to licenses, permits, and insurances. AVC SERVICES, LLC dba CHOOSE SMART NOW does not provide any type of insurance including but not limited to health insurance and worker’s compensation or any other related compensation to drivers. Therefore, all drivers are responsible to purchase a health insurance prior to start working for the company.
All drivers are responsible to handle the items with due care and to notify the shipper and platform’s support about any and all changes that are related to the freight shipment.
All drivers may be required to undergo a standard background check that will be conducted by a third-party. All drivers upon registration will fill out the pre-approval form and are required to provide personal information, including but not limited to legal name, address, SSN/EIN. It is the responsibility of a driver to provide correct and accurate information at all times.
AVC SERVICES, LLC dba CHOOSE SMART NOW guarantees that your freight will arrive in the original condition as it was when the driver picked it up. Shippers will be notified by the drivers of all existing damages before transporting the freight and drivers may cancel the order due to this reason. Damage during transportation from pick up to drop off locations will be repaired or replaced by CHOOSE SMART NOW up to $25,000 in value.
While using our Services, all users will have access to confidential information, including such information of AVC SERVICES, LLC dba CHOOSE SMART NOW, shippers, and drivers. The term “confidential information” includes all kind of information that are provided to the user with the connection to the services rendered or received by using AVC SERVICES, LLC dba CHOOSE SMART NOW Services. All users are subject to maintain the complete confidentiality of all such information. Under no circumstances any user may disclose and use confidential and personal information for any other reason than to perform or receive services at AVC SERVICES, LLC dba CHOOSE SMART NOW.
It is the responsibility of all shippers to know and oblige to all the applicable federal, state, and local laws concerning delivery. Shippers acknowledge that it is their responsibility to package the item appropriately. AVC SERVICES, LLC dba CHOOSE SMART NOW will not be held liable for any damage or loss if it is not properly packaged for transportation, including if it is not in accordance with all the applicable laws. Shipper will be held liable for all the liabilities arising from shippers’ failure to comply with these terms or any other applicable laws. All shippers are expected to pay the full price of a delivery, including for all the price adjustments that would apply.

No hazardous waste that meets any criteria
No hazardous materials by FMCSA
No firearms, ammunition, or other explosive materials
And no all other items that are not mentioned here but violate any applicable law, statute, ordinance, or regulation.
AVC SERVICES, LLC dba CHOOSE SMART NOW takes no responsibility or liability for the inclusion of any prohibited items and may suspend or deactivate any user account if one or any items from the following list would be transported. All users involved in transportation of prohibited items may be subject to legal penalties. Under no circumstances damage during transportation from pick up to drop off locations of prohibited items will be repaired or replaced by AVC SERVICES, LLC dba CHOOSE SMART NOW.
Payment processing services for users on the Platform provided by a third party and are subject to separate terms and conditions. By using our services, you agree to be bound by applicable terms and conditions, as the same may be modified from time to time. As a condition of Platform enabling payment processing services through third party, all users agree to provide accurate and complete information about you and your business, and you authorize the platform to share it and transaction information related to your use of the payment processing services provided by the third party.
Actual charges may vary based on factors outside of our control, such as but not limited to wait time, special requests, additional stops, return to pick up. All shippers are fully responsible for actual charges that may vary from the quote and platform price. All charges are due immediately and payment will be facilitated by using the preferred payment method designated in your user account.

All users are solely responsible for any and all taxes, charges, fee incurred or that may be payable to any authority in connection with the platform services.
AVC SERVICES, LLC dba CHOOSE SMART NOW reserves the right to keep any and all records of transaction documentations and communications between all users for the purposes that may arise in accordance with all applicable laws and regulation.
AVC SERVICES, LLC dba CHOOSE SMART NOW will not be responsible for the conduct, online or offline, of any users of the platform. AVC SERVICES, LLC dba CHOOSE SMART NOW will not be liable for any losses, claims, injuries, damages arising in connection with the use of the platform.
All AVC SERVICES, LLC dba CHOOSE SMART NOW products are provided strictly on “as is” and “as available” basis without any warranties, expressed or implied. All users use the services at their own risks.
AVC SERVICES, LLC dba CHOOSE SMART NOW is not responsible for any services offered by third party through the platform and applications.
To the maximum extent permitted by applicable law, in no event shall AVC SERVICES, LLC dba CHOOSE SMART NOW, its affiliates, agents, directors, employees, licensors be liable for any indirect, punitive incidental, special, consequential or exemplary damages.
AVC SERVICES, LLC dba CHOOSE SMART NOW owns all intellectual property rights in and to the platform and the applications, including but not limited to databases rights, copyrights, design rights, trademarks and other, whether or not currently registered, whenever existing in the world together, with full right to apply for protection of the same, and your use of the platform applications gives you no right therein.
